Illegitimate Children

If a man commits fornication (pre-marital intercourse) or adultery (extra-marital intercourse), the resulting child will be illegitimate. There will be no ties of inheritance between the man and the child.

If an unmarried woman commits fornication, although the resulting child will be illegitimate, it will still inherit from the mother and the mother will inherit from it.

If a married woman commits adultery, the resulting child will be legitimate according to the Shari`ah and be attributed to the woman’s husband. The child will inherit from the mother and her husband, and the mother and her husband will inherit from the child. There are no ties of inheritance between the biological father and the child.

In summary, a man who begets a child through zina (fornication/adultery) has no ties of inheritance with the child. However, a woman who begets a child through zina has ties of inheritance with the child.
